Terms

The term ‘we’ when used refers to CGM Property Inventory Ltd.

The term ‘client’ or ‘instructing principal’ means the person, firm or company that has engaged CGM Property Inventory Ltd to carry out the services for example estate agents, letting agents, landlords, property management agencies and tenants or another third party contractor.

CGM Property Inventory Ltd are an independent property inventory service provider.

Provision of Services

It is the responsibility of the client or their representative to be aware of these terms and conditions of business provided by CGM Property Inventory Ltd.

 

CGM Property Inventory Ltd do not accept or recognise a plea of ignorance by either the instructing principal or that of the client.

Fees and Payment

All clients are invoiced after the service is completed. Invoices must be paid within 14 days of receipt unless otherwise agreed in writing by CGM Property Inventory Ltd.

 

It is the responsibility of the instructing principal to pay for all services provided by CGM Property Inventory Ltd as quoted on the invoice.

 

If the client is not represented by an instructing principle the client will pay all fees due within the period agreed on the invoice.

 

CGM Property Inventory Ltd reserves the right to apply interest charges for the late payment of any fees overdue for more than fourteen working days after the period stated on the presented invoice, at a rate of 4% net which will be added monthly.

 

Prices quoted are based on a standard property including 1-2 reception rooms, 1-2 bathrooms, 1 kitchen, 1 garage or outbuilding and average gardens.

 

We request that clients ask for a quotation on large or unusual properties that fall outside standard specification to ensure pricing transparency. Prices will be quoted on application.

 

Oversized properties will be subject to additional room/area charges of £10 per additional room/area.

 

Bookings for Sundays or bank holidays will be subject to a £15 surcharge.

 

Costs for parking obtained during the appointment (inventory/Check in etc) may be charged on the invoice, with proof of parking tickets, where free parking has not been provided.

 

In the event a CGM Property Inventory Ltd representative attends an appointment as instructed by a client and the service cannot be carried out whether or not this is due to circumstances beyond the clients control, CGM Property Inventory Ltd reserve the right to charge an abortive fee of £35.00.

 

In the event any discrepancy caused by the instructing principal and/or the client, resulting in the service needing to be carried out again, the second or ‘new’ appointment will be treated completely separate to the prior and charged at full cost.

 

A cancellation charge of £35 will be charged for all cancelled visits with less than 4 hours notice.

 

All reports generated by CGM Property Inventory Ltd will be sent to the instructing client within 24 hours in PDF electronic format by email. Hard copies are available on request at a surcharge of £20 per copy. All reports produced by CGM Property Inventory Ltd remain the sole property of CGM Property Inventory Ltd until all fees are paid in full.

 

A copy of the completed report is available in multiple languages at an additional cost. Please discuss this when making the booking.

 

Any report produced by CGM Property Inventory Ltd cannot be reproduced, replicated or amended by any other agent or inventory company at a later date for any other purpose except with written consent from CGM Property Inventory Ltd.

Disputes and complaints

Any circumstances allegedly giving cause for complaint about the services or invoice for services provided by CGM Property Inventory Ltd must be notified by the client and/or instructing principle on behalf of the client within 7 working days of the services being completed and/ or before any tenancy deposit/ bond is returned to the tenant.

 

CGM Property Inventory Ltd does not accept any responsibility for any error or omission of data within a report.

 

In the event of a dispute between clients and all fees have not been paid in full, any reports delivered by CGM Property Inventory Ltd, remain the sole property of CGM Property Inventory Ltd and therefore cannot be used in any way without written permission.

 

Whilst every care will be taken at the time of the appointment CGM Property Inventory Ltd do not accept responsibility for any accidental damage to the property, its contents, fixtures and fittings caused by the inventory clerk undertaking the inspection.

 

CGM Property Inventory Ltd cannot be held accountable or liable in any way for any damage, negligence, loss of profits, loss of data or other intangible losses that arise from the provision of our services.

 

CGM Property Inventory Ltd reserves the right not to attend court for any dispute arising out of a dilapidation assessment between clients if a CGM Property Inventory Ltd representative did not attend the original check-in appointment or sign on behalf of the client.

 

Services

It is highly advisable to book a new full inventory and check in for every new tenancy, as well as having a check out carried out at the end of each tenancy. This offers you and your clients full protection from any damage/dilapidation or missing fixtures and furnishing disputes. A ‘fully detailed professionally compiled inventory should be produced before re-letting since old reports do not offer any protection for landlord or tenant.’

 

The reports prepared by CGM Property Inventory Ltd are intended as an independent, fair and accurate record of the décor, fixtures and fittings and furniture which compose the internal content of the property, the condition of these items and the internal condition of the property. The report enables items to be visually identified only; no attempt will be made to ascertain the original manufacturer or period in which an item was produced. The report is no guarantee of the adequacy, or safety of all/any furniture, equipment and contents, merely a record that they exist in the property and the time the report is carried out.

 

CGM Property Inventory Ltd staff are not trained or qualified Property Surveyors. Under no circumstances should this Inventory Report be used as a structural survey of a property. Further to this it should be noted that we are not specifically trained or qualified as legal experts on any type or kind of cloth, wood or other material, nor do we have any specific knowledge of antiques. As an example 'Gold', 'Steel', 'Wood', 'Mahogany', etc. may be used to describe the colour of an item in does not mean that the item is made from that particular material, metal or element. These descriptive words are used by the Clerk to help describe the appearance, look, feel of the element. This Inventory Report should not be deemed to be a definitive statement of each and every item of equipment or furniture, nor indeed of the authenticity of the aforementioned items.

 

The CGM Property Inventory Ltd representative will not undertake to move heavy, large, awkward and/or valuable items of furniture.

 

Items left in inaccessible places, lofts, cellars or in any areas behind locked doors will not be listed and/or inspected and are the sole responsibility of the client. Gardens, garages, sheds and outbuildings will be inspected if access is available. Communal areas will not be inspected unless agreed otherwise.

 

CGM Property Inventory Ltd conducting this report reserve the right to update any report they conduct after the inspection to reflect any issues missed due to furniture blocking an issue, cleaning issues blocking the full extent of any damages, lighting etc.

 

Where there are numerous or substantial amounts of general items, example books, cutlery, bric-a-brac, cupboard contents etc. the Clerk may employ such terminology as “A number of books / Many books” etc. The plural term Cutlery, Glasses. Plates etc. is used when counting individual items would be time consuming. If an accurate record of the exact number of individual items are required, this must be agreed in advance with the Clerk and the extent of the contents to be counted so an accurate time scale maybe calculated and the cost of carrying out the extra work.

 

It is important to note that any contents must be situated in their respective rooms as specified in the report upon termination of the tenancy. Failure to do so will result in delay on appointment.

 

CGM Property Inventory Ltd will NOT attempt to test electrical appliances for power. All electrical items are deemed complete with fixings (plugs, flexes etc) unless otherwise stated.

 

Utility meter readings will be read and noted at check-in and check-out. It is the clients and/or instructing principle on behalf of the client responsibility to state the location of any such utility meters. If unaware of, unable to locate or has unreasonable access to meters, the meters will remain unread. CGM Property Inventory Ltd reserve the right to refuse to return to a property at a later stage on behalf of the client and/or instructing principle to read the utility meters.

 

The instructing principal and/or client are responsible for the security, heating, and plumbing and meter usage of the property both pre and post CGM Property Inventory Ltd service.

 

It has to be accepted that any time lapse between the completion of the inventory report and the check-in and/or check-out and subsequent check-in, cannot be independently verified by CGM Property Inventory Ltd. It has to be acknowledged that some alterations (any amount of damage, items removed or added) to the property may occur within this period.

 

Where CGM Property Inventory Ltd are instructed to undertake a check out report based upon an inventory not carried out by us, no responsibility will be accepted if the quality of that report is not our standard.

 

Once keys have been signed over to the client, CGM Property Inventory Ltd cannot accept any responsibility for any lost or unaccounted keys. CGM Property Inventory Ltd can and will endeavour to hand over keys at check ins wherever required to do so within a booking. This in no way makes CGM Property Inventory Ltd liable for the tenant or person that arrives at the property claiming to be or acting for the expected tenant. CGM Property Inventory Ltd can ask for ID but CGM Property Inventory Ltd are still in no way liable for this being correct, appropriate or genuine, or them even having ID on them.

 

CGM Property Inventory Ltd has the right to amend any part of the service and/or pricing at their discretion in line with future market changes or updated legislation or deemed to be relevant by CGM Property Inventory Ltd.

 

CGM Property Inventory Ltd retains the copyright of all images taken by CGM Property Inventory Ltd.

 

CGM Property Inventory Ltd retains the right to use photos taken by CGM Property Inventory Ltd for marketing purposes such as social media page, Website and other business related purposes.

By entering our website or contacting us via any method, you are agreeing to our terms and conditions in full as stated above.

 

Dilapidations

On the Check-Out day/termination of the tenancy, the Inventory Clerk will compare the property against the Inventory Report used at the start of the Tenancy. The Check-Out report will detail any differences with the condition and cleanliness of the property and its fixtures and fittings. An allowance will be made for Fair Wear and Tear and any deterioration or damage to the property and its fixtures and fittings will be noted.

 

CGM Property Inventory Ltd does not accept the responsibility of any dilapidations and/or remuneration for any such dilapidations noted or not noted on the report.

Regulations

All regulations published by the Department of Trade and Industry / Trading Standards / or any similar parties are the responsibility of the instructing principle and/or the client.

 

CGM Property Inventory Ltd and its staff do not check gas or electrical appliances and give no guarantee with regard to the safety or reliability of such items.

 

Where CGM Property Inventory Ltd reports note that a/any certificate has been seen i.e. The Electrical Equipment Safety Regulations 1994, The Plugs and Sockets etc Safety Regulations 1994, The Gas Safety Regulations 1994 etc, this should not be interpreted to mean any records can be authenticated by CGM Property Inventory Ltd. It is not a statement that an item can be considered to comply with the required regulations, merely a documented note that a certificate existed on the date the report was carried out.

Where the report notes ‘fire label seen’ this should not be interpreted to mean the item complies with the ‘Furniture and Furnishings’ (Fire, Safety & Amendments) 1993. It is a record that the item had a label as described or similar to that detailed, in the ‘Guide to the Furniture and Furnishings’ (Fire)(Safety) Regulations as published by Department of Trade and Industry, January 1997, (or subsequent edition), attached at the time the report was compiled. It is not a statement that the item can be considered to comply with the regulations.

 

Compliance with the relevant UK Fire Regulations is the responsibility of the client not CGM Property Inventory Ltd. It is recommended that all bedding, soft furnishing or any item which is filled/padded be checked by the client to ensure that they comply with current regulations. Regulations on furniture purchased in foreign countries may not meet the UK standards. It is the clients responsibility to ensure that all items adhere to relevant current UK regulations.

 

The Smoke and Carbon Monoxide Alarm (England) Regulations 2015. As of 1st October 2015: Only standard battery driven smoke alarms & CO detectors are tested, where possible. This test will be for power only and is not a statement that the alarms are in full working order should an incident occur. The inventory clerk will take no responsibility for damage or malfunction during the testing of such alarms.

 

It is strongly recommended that the instructing client ensures all regulations are met before the tenancy commences.

 

Exclusions of liability and indemnity

In the event that the client and/or instructing principle give CGM Property Inventory Ltd instructions which are followed in good faith and which turn out to be unlawful or result in an unlawful act or otherwise give rise to any other claim, you will provide CGM Property Inventory Ltd with full indemnity for all penalties, damages, costs and legal expenses whatsoever which may occur as the result of following the instructions.

 

Law and Jurisdiction

This contract shall be governed by English law in every particular including formation and interpretation and shall be deemed to have been made in England.

 

Any proceedings arising out of or in connection with this contract may be brought in any court of competent jurisdiction in England whose courts shall have exclusive jurisdiction.

 

Modifications of these conditions of use

CGM Property Inventory Ltd reserves the right to change the terms, conditions and notices at any time and such modifications shall be effective immediately upon posting of such changes. The client and/or instructing principal are therefore responsible for regularly reviewing these Terms and Conditions and additional terms or notices posted on CGM Property Inventory Ltd website. The continued access of this website shall be deemed the client and/or instructing principle conclusive acceptance of the modified agreement.

 

Disclaimer of warrant/limitation of liability

CGM Property Inventory Ltd website and related information is provided by CGM Property Inventory Ltd on an ‘as is’ and ‘as available’ basis. CGM Property Inventory Ltd makes no express or implied warranties, representations or endorsements of any kind, or as to the operation of the website or the information, content, included on the website. You expressly agree that your use of the website is at your sole risk.

 

To the full extent permissible by applicable law, CGM Property Inventory Ltd disclaims all warranties, express or implied, including without limitation, implied warranties of merchantability and fitness for a particular purpose. CGM Property Inventory Ltd does not warrant that the website, its servers, or e-mail sent from CGM Property Inventory Ltd are free of viruses or other harmful components. CGM Property Inventory Ltd will not be liable for any damages of any kind arising from the use of the site, including, but not limited to direct, indirect, incidental, punitive and consequential damages.
